ND Law Visiting Assistant Professor Jorge Barrera-Rojas cited by the Chilean Constitutional Tribunal

ND Law's Visiting Assistant Professor of Law Jorge Barrera-Rojas was cited by the Chilean Constitutional Tribunal in a dissenting opinion concerning education. Barrera-Roja is the Rodes Jr. Fellow in Law and Religion for the Program on Church, State & Society at Notre Dame Law School.

In a 6-4 decision, the court ruled that the obligation to provide “non-sexist education” for private and public primary and secondary schools is constitutional. The dissenting opinion cited Barrera-Rojas’ "Right to Education and Academic Freedom: Evolution of the Chilean Constitutional Tradition Before a New Constitution" that was published in 2021. The piece was co-authored with Professor Miguel Angel Fernández of the Chilean Association of Constitutional Law and included in the book "Constitutional Transition: The Way to a New Constitution.”
